This Website is owned and operated by Wolfpack Weekends Adventure Co LTD. By using any of the Services and the Website, you expressly agree to be bound by these terms and all applicable laws and regulations governing the Website and the Services. The terms form a legally binding agreement between you and www.wolfpackweekends.com in relation to your use of the Website and/ or the Services and applies to all users of the Services, whether registered or not, on the Website.

As used in this Agreement, “www.wolfpackweekends.com", "we," "us," and "our" shall mean Wolfpack Weekends and its subsidiaries and affiliates. By accessing or using the services available through our Website (the "Services"), and you agree to be bound by these Terms of Service. These Terms do not alter in any way the terms or conditions of any other agreement you may have with Wolfpack Weekends for services or otherwise. If you are using the Services on behalf of any entity, you represent that you are authorized to do so.

We may, at our sole discretion, modify or revise these Terms of Service, policies and price of services such as of Wolfpack Weekends at any time by giving notice on our Website and/or through the Services, and you agree to be bound by such modifications or revisions. In the interest of clarity, it is stated that any free service can be converted into paid subscription service at any given time. Although Wolfpack Weekends may attempt to notify you, when major changes are made to these Terms of Service, you should periodically click on our Terms of Service to review any updates. All changes shall be effective immediately when we post them and shall apply to all access to and use of our Website thereafter. Nothing in these Terms of Service shall be deemed to confer any third-party rights or benefits hereunder.

THIS IS A LEGAL AGREEMENT. BY PURCHASING OUR SERVICES OR USING THE SITE, YOU ARE ACCEPTING AND AGREEING TO THESE TERMS & CONDITIONS ON BEHALF OF YOURSELF OR THE ENTITY YOU REPRESENT. YOU REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, AUTHORITY, AND CAPACITY TO ACCEPT AND AGREE TO THESE TERMS & CONDITIONS ON BEHALF OF YOURSELF OR THE ENTITY YOU REPRESENT. YOU REPRESENT THAT YOU ARE OF SUFFICIENT LEGAL AGE IN YOUR JURISDICTION OR RESIDENCE TO ENTER INTO THIS AGREEMENT. IF YOU DO NOT AGREE WITH ANY OF THE PROVISIONS OF THESE TERMS & CONDITIONS, YOU SHOULD CEASE USING THE WOLFPACK WEEKENDS PLATFORM..

Applicable Laws shall mean and include all applicable statutes, enactments, acts of legislature or parliament, provincial laws, ordinances, rules, by-laws, regulations, notifications, guidelines, policies, directions, directives and orders of any governmental authority, tribunal, or a court of Canada.

Advertising Regulation means any present or future code of practice, including the Broadcast Canadian Code of Advertising, adjudication, decision, direction or rule of any Advertising Regulator and includes any modifications, amendments or extensions thereof in force from time to time.

Content means report text, graphics, images, music, software, audio, video, information or other materials.

You/User/Customer is a person who purchased the Wolfpack Weekends Services and or completes Wolfpack Weekends’ account registration process.

Representative means, an entity and its Affiliate(s), any director, officer, employee, consultant, contractor, agent, distributors and attorney associated with the Company.

Site or Sites means www.wolfpackweekends.com

Third-Party means services offered by the organization/individual who is not a party to this Agreement.

Ambit of service:

Wolfpack Weekends makes arrangements with hoteliers, local tour operators and other independent parties to provide Services to the Customer. Although Wolfpack Weekends takes care in selecting its suppliers, it has no control over them and cannot be held responsible for their actions, faults, omissions, or negligence or that of their employees or sub-contractors, nor for any loss or damages suffered as a result thereof. Services provided are subject to the conditions imposed by the third-party suppliers, and their liability is limited by their conditions of carriage. tariffs, tickets, vouchers, international conventions and agreements. The Terms of Service of this section shall extend to and benefit all of Wolfpack Weekends’ representatives, agents and employees. In the event, that third parties require a specific license(s) to take part in their activities, or if they require the Customers to abide by certain rules and regulations, the Customer agrees to do so.

Sports and other activities described on www.wolfpackweekends.com are provided for information purposes only and are not meant to incite Customers in any way to participate in them. Wolfpack Weekends cannot be held liable for any accident or mishap occurring at the destination during the practice of any sport and/or activity in which Customers participate of their free will and initiative.

Covid-19

Due to the impact of COVID-19 and to unforeseeable ever-changing conditions on arrival, portions of your package (such as hotel amenities/services, excursions, ground transport, etc.) to be provided by third-party suppliers may be different from what is advertised, including being reduced, unavailable or subject to specific conditions. By booking, you understand and accept the foregoing and agree, to the maximum extent permitted by law, Wolfpack Weekends cannot be held liable for such changes. If Wolfpack Weekends becomes aware of such changes in advance, it shall, in certain situations, promptly provide notice to you and offer a refund or comparable alternate travel services acceptable to you.

Prices:

Every party is bespoke and different in terms of group size and date etc. hence Wolfpack Weekends does not list the pricing on its Website. Unless otherwise indicated, all prices quoted shall be in Canadian dollars on a per person basis on double occupancy and include the applicable retail sales tax, the federal goods and services tax, and governmental and administration fees. Some taxes and facility fees are not included. The price of Services does not include insurance, the Customer's personal tips, expenses, telecommunications costs or any other additional services or activities that are not specifically described.

Deposit: Any reservation of Services made 45 days or more prior to the commencement of the package must be accompanied by a 25% non-refundable deposit made by the group organizer to secure the event. The rest of the group shall make their initial deposit of 25% within two weeks from the day the event was secured. The remaining 75% due shall be paid 45 days before the event date by all the members. For any events taking place within 45 days, the full balance will need to be paid by each person.

On occasions, a larger initial deposit or full pre-payment will need to be made to secure accommodation. This is dependant on the cancellation policy of the accommodation chosen and will be outlined at time of booking.

Additionally, sometimes the 75% balance will need to be paid further in advance than 6 weeks from the event. This is due to some accommodation options and their policies on when a booking is fully refundable. This will be outlined to you at the time of booking if appropriate.

If any member of the group withdraws itself from the package, Wolfpack Weekends reserves the right to change the package price depending on bookings made. So that another payment or refund may be received or refunded. Wolfpack Weekends will try its best to inform the customers at its earliest about the payment to be received or refunded.

Cancellation: In the event of Cancellation, all deposits made shall be non-refundable. If the Cancellation is made more than 45 days before the event, the Customers shall only lose their deposit. If the Cancellation is within 45 days of the event, then 100% of the total cost will be charged.

In the event the final payment is not received within the required period from all the members, Wolfpack Weekends reserves the right to cancel or change any such reservation, in whole or in part, without recourse by the Customer and without prior notice, and charge the applicable cancellation fees.

Electronic confirmations and other travel documents (if any) will be issued only if full payment by all the members for the Services has been received. It is the responsibility of the Customer to ensure that the information shown on all travel documents and other documents is accurate and in accordance with the reservation

Refusal to transport/removal of Customer: Wolfpack Weekends shall not be liable if Customer jeopardizes public safety during of the activities, Customer does not hold the proper travel documents or the latter is invalid, a Customer violates or may violate any applicable law, the final payment is not honoured, or Wolfpack Weekends deems it necessary to deny participation of the Customer in any activity in order to prevent any danger or risk to such Customer or to any other person or property.

Travel Insurance

Wolfpack Weekends highly recommends the purchase of travel insurance at the time of purchasing the packages to cover against unexpected events, namely trip Cancellation, damage to, or loss of baggage and insurance covering medical costs abroad. Wolfpack Weekends shall not be liable for unexpected events, namely trip cancellation, damage to, or loss of baggage.

User’s/Customer’s Obligations

You and all members of the group agree and acknowledge to ensure that all members of the group act at all times in a responsible and safe manner and shall comply with all the safety procedures, listen and be present at all safety and information briefings which are relevant to the arrangements booked. You should disclose to the third-party activity organizer(s) of any health concerns or any other inabilities such as not knowing how to swim before participating in the relevant activity. Many events and activities may require a high level of concentration, therefore the use of alcohol or drugs or being under the influence of alcohol or drugs whilst participating in such events is strictly forbidden. If you or any member of your group have, in the reasonable opinion of any third-party activity organizer(s), been using drink or drugs or fail to act in a safe and responsible manner, they reserve the right to cancel your participation forthwith. In such an event we will not be liable to pay you any refund, compensation or any costs / expenses incurred by you.
Certain events are part of normal unpleasant occurrences which may arise when travelling abroad or in the same country. The Customer acknowledges these possibilities and solely assumes the consequences thereof and agrees that Wolfpack Weekends cannot be held liable
The consequences thereof and agrees that Wolfpack Weekends cannot be held liable in the following events:

Service disruptions: Certain services, namely local public water, hot water, electricity, safety equipment, air-conditioning and other similar services or benefits, may be completely or partially suspended or interrupted during the stay.

Water, Food, and beverages: The quality of water, food, and beverages served abroad may differ from your home country and therefore may lead to health issues or illness. Wolfpack Weekends cannot be held liable for any illness or health problems resulting therefrom, and the Customer is advised to take all necessary precautions.

Insects: Insect life thrives in certain climates and can therefore be commonly found outside and inside of any hotel, or while performing any outdoor activity regardless of its rating. Wolfpack Weekends cannot be held liable for any illness or any health problems resulting therefrom, and Customers are advised to take all necessary precautions.

Maintenance: In order to maintain the quality of Services, hotels must regularly undergo renovation, maintenance, improvement and work and, in some instances, expansion. Whenever maintenance or construction, or work likely to interfere with the use and enjoyment of any accommodation is brought to the attention of Wolfpack Weekends, every responsible effort will be deployed to notify Customers at the earliest; however, Wolfpack Weekends cannot be held liable for any inconvenience caused to Customers.

School breaks, religious holidays, elections and conventions: Certain inconveniences, such as unavailability or Cancellation of some Services, may arise when travelling during periods designated as school breaks, religious holidays, elections or conventions. Given that these periods vary according to the country and provinces and relevant authorities, it is practically impossible for Wolfpack Weekends to provide any indication of such dates. The Customer acknowledges and agrees that this and solely assumes the possible consequences of travelling during these periods.

Assignment of rooms: Hoteliers are solely responsible for hotel assignment in accordance with the category reserved by the Customer. Wolfpack Weekends has no responsibility with respect to the furnishings, decor or type of bed in a hotel room, which may vary according to the location of the room on the hotel premises. Should a Customer choose to alter the room category upon arrival at the destination, such change may be made subject to availability and additional fees. Please contact the hotelier for any hotel room change.

Hotel check-in and checkout: The Customer acknowledges and agrees that the check-in time for most hotels is from 3 PM. Checkout time can vary depending on the hotel, but it is usually before 11 AM on the day of departure. Customers who wish to check out later than the established time may be required to pay additional fees by the hotel. Whenever drinks and/or meals are included in a Package, the Customer is eligible for said services from the time of check-in until the time of checkout.

Changes to travel Services:

Changes to Travel Services: by Wolfpack Weekends: In the event, that certain booked Services are no longer available prior to the Customer’s departure or after arrival at the destination, Wolfpack Weekends reserves the right to replace them with comparable Services, or alternatively, to cancel them. If the replacement Services are of lesser value, Wolfpack Weekend’s liability shall be limited to the sole difference in the cost. If the replacement Services are of greater value, the Customer shall be required to disburse an amount equal to the difference between the price of the Services initially purchased and that of the replacement Services. The Customer shall be entitled to refuse such replacement Services if they occur prior to departure. In the event of a cancellation, Wolfpack Weekends’ liability shall be limited to the reimbursement of the amount disbursed by the Customer for the said Services.

Itineraries and times provided to the customers are for reference only and are subject to change. Itineraries, outdoor activities, accommodations or means of transportation are subject to change without notice. Third-party activity operators reserve their right to alter or substitute alternative itineraries with or without prior notice to the Customer, such decision being final and without any recourse against Wolfpack Weekends.

Changes to the reservation by the Customer: In certain circumstances, Wolfpack Weekends or the supplier shall allow Customers to make certain changes to their reservation. In the event, such change is not permitted, or the Customer chooses not to use the Services purchased or travel, the applicable cancellation fees for the Services shall apply.

Health status:

Customers whose physical condition so requires must ensure that they have a sufficient quantity of any required medication with them when they travel. Customers must also consult competent medical authorities prior to departure to enquire about preventive medical measures to be taken as regards the country visited. Customers are also responsible for ensuring that they are autonomous and fit to travel.

Use Of The Services

You will not prepare the replica of our product and or use, copy, adapt, modify, decompile, reverse engineer, disassemble, decrypt, attempt to derive the source code, prepare derivative works based upon, distribute, license, sell, rent, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the product and Content, except as expressly permitted by Wolfpack Weekends or as permitted under applicable law. Any unauthorized use of the Services is strictly prohibited and will terminate the license granted in these Terms. No licenses or rights are granted to you by implication or otherwise, except for the licenses and rights expressly granted to you.

Wolfpack Weekends will not be liable on account of any inaccuracy of information on this Website. It is the responsibility of the visitor to further research the information on the Website. The user undertakes not to duplicate, download, publish, modify and distribute material on Wolfpack Weekends unless specifically authorized by Wolfpack Weekends in this regard

Any and all contents and services (including advertising) within Wolfpack Weekends that are not owned by Wolfpack Weekends are "third-party content and services." Wolfpack Weekends acts merely as an intermediary service provider of, and accepts no responsibility or liability for third-party Content.

The Website and all worldwide copyrights, trade secrets, and other intellectual property rights therein are the exclusive property of Wolfpack Weekends and its licensors. Wolfpack Weekends and its licensors reserve all rights in and to the Website not expressly granted to you herein. There are no implied licenses herein. All suggestions or feedback provided by you to Wolfpack Weekends with respect to the Website shall be Wolfpack Weekends’ property. You acknowledge and agree that Wolfpack Weekends owns, controls or is licensed all legal right, title and interests in and related to the Product and Website, including all intellectual property rights. You may not:

WOLFPACK WEEKENDS SHALL NOT BE LIABLE FOR ANY CLAIM, DAMAGE OR LOSS TO A PERSON OR TO PROPERTY, EXPENSE, COST, INCONVENIENCE, LOSS OF ENJOYMENT OR OF TIME, FRUSTRATION, DISAPPOINTMENT OR, WHETHER MENTAL OR PHYSICAL, RESULTING FROM ANY DELAY, CANCELLATION, ILLNESS ACCIDENT, INJURY OR DEATH RESULTING FROM, BUT NOT LIMITED TO:

EXCURSIONS, SIGHTSEEING TOURS OR ACTIVITIES (COLLECTIVELY, THE “EXCURSIONS”) THAT MAY BE OFFERED BY WOLFPACK WEEKENDS SHALL NOT BE HELD LIABLE FOR THE QUALITY OR SAFETY OF SUCH EXCURSIONS THAT ARE ORGANIZED AND CONDUCTED BY A THIRD-PARTY SUPPLIER WHO MAY ADHERE TO SECURITY STANDARDS AND NORMS THAT MAY DIFFER FROM THOSE OF THE CUSTOMER’S COUNTRY OF ORIGIN. ANY WRITTEN OR VERBAL CONTRACT AND REPRESENTATION FOR SUCH EXCURSIONS SHALL BE DEEMED TO HAVE BEEN MADE BETWEEN THE CUSTOMER AND THE SUPPLIER OF SUCH EXCURSIONS AND SHALL BE UNDERTAKEN AT THE CUSTOMER’S OWN RISK OF LOSS, DAMAGE OR INJURY.

THOSE WHO ACCESS OR USE THE SERVICES FROM OTHER JURISDICTIONS DO SO AT THEIR OWN VOLITION AND ARE RESPONSIBLE FOR COMPLIANCE WITH LOCAL LAW.

WOLFPACK WEEKENDS AND OUR LICENSORS AND SUPPLIERS MAKE NO WARRANTY THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICES: (I) WILL MEET YOUR REQUIREMENTS; (II) WILL BE COMPATIBLE WITH YOUR HOME NETWORK, COMPUTER OR MOBILE DEVICE; (III) WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS; OR (IV) WILL BE ACCURATE OR RELIABLE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM WOLFPACK WEEKENDS OR THROUGH THE SERVICES SHALL CREATE ANY WARRANTY.

YOU UNDERSTAND AND AGREE THAT THIS LIMITATION OF LIABILITY IN THIS SHALL APPLY EVEN IF WOLFPACK WEEKENDS IS FOUND LIABLE FOR ANY LOSS OR DAMAGE DUE TO BREACH OF CONTRACT, BREACH OF EXPRESS OR IMPLIED OR LIMITED WARRANTY, NEGLIGENCE OF ANY KIND OR DEGREE, STRICT PRODUCT LIABILITY, SUBROGATION, INDEMNIFICATION OR CONTRIBUTION, OR ANY OTHER THEORY OF LIABILITY. HOWEVER, THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO ANY WILLFUL, WANTON, INTENTIONAL OR RECKLESS MISCONDUCT OF WOLFPACK WEEKENDS OR GROSS NEGLIGENCE OF WOLFPACK WEEKENDS IN THOSE STATES THAT DO NOT PERMIT LIMITATION OF LIABILITY FOR GROSS NEGLIGENCE.

THE COMPANY HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

General.

Wolfpack Weekends Services rely on or inter-operate with third-party products and services. These third-party products and services are beyond Wolfpack Weekends ’s control, but their operation may impact or be impacted by the use and reliability of the Wolfpack Weekends Services. You acknowledge and agree that: (i) the use and availability of the Services is dependent on third party product vendors and service providers, (ii) these third-party products and services may not operate in a reliable manner 100% of the time, and they may impact the way that the Wolfpack Weekends Services operate, and (iii) Wolfpack Weekends is not responsible for damages and losses due to the operation of these third-party products and services.

Wolfpack Weekends does not control, and is not responsible for e-mails sent from outside Wolfpack Weekends’ domain or other means of electronic communication; and by using the Website and the Service, you may be exposed to Content that is, inaccurate or otherwise misleading. You acknowledge and agree that you are responsible and bear all risks associated with the use of our Services, and that under no circumstances will Wolfpack Weekends be liable in any way for any loss or damage of any kind incurred as a result of our Services.

Users will not use the Services if any applicable law in their country prohibits them from doing so and or has not previously been their right to use the Services suspended or terminated.

You agree to release Company, its parents, partners, contractors and affiliates, together with their respective employees, agents, officers, directors and shareholders, from any and all liability and obligations whatsoever in connection with or arising from your use of our Services. If at any time you are not happy with the product or the Services or object to any Content, your sole remedy is to cease using them.

Electronic Communications

When you send an e-mail or chat electronically with Wolfpack Weekends, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail. You agree that all agreements, notices, disclosures and other communications that Wolfpack Weekends provides to you electronically satisfy legal requirements that such communications be in writing

Termination

In its sole discretion, Wolfpack Weekends reserves the right to terminate your right to access and use the Services if you violate these Terms or any other terms or policies referenced herein, or if you otherwise create risk or possible legal exposure for us.

Entire Agreement/ Severability

These Terms of Service constitute the entire Agreement between You and Wolfpack Weekends in relation to Your use of our Website and/ or the Services and supersedes any prior representations, inducements or agreements relating to its subject matter. You agree that these Terms of Service are not intended to confer and do not confer any rights or remedies upon any third party. If any part of these Terms of Service is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties and the remaining portions shall remain in full force and effect. These Terms of Service, including all terms and policies referenced herein, contain the entire understanding and supersede all prior agreements between you and Wolfpack Weekends relating to this subject matter and cannot be changed or terminated orally.

Assignment

You may not assign these Terms or any of the rights granted hereunder without the prior written consent of Wolfpack Weekends, and any attempted assignment without such consent shall be void. Subject to the foregoing restriction, these Terms will be fully binding upon, inure to the benefit of, and be enforceable by our respective successors and us and assigns.
Non-waiver

Failure by either Wolfpack Weekends or You to exercise or enforce any right conferred shall not be deemed to be a waiver of any such right nor operate so as to bar that exercise or enforcement thereof or of any other right on any later occasion.

Indemnification

You agree to defend, indemnify and hold harmless Wolfpack Weekends and its respective employees, contractors, officers, directors, shareholders, agents, representatives, vendors, and content providers from and against any and all liabilities, claims and expenses, including attorneys' fees, that arise from a breach of these Terms of Service for which you are responsible or in connection with your transmission of any content to, on or through our Website. Without limiting your indemnification obligations described herein, we reserve the right, at our own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you.

Force Majeure

Wolfpack Weekends shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control; including, without limitation, any failure to perform hereunder due to unforeseen circumstances or causes beyond its control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labour or materials;

Any war, revolution, insurrection, riot, embargo, terrorist act or consequences thereof, closure of borders or airspace, nuclear disaster or any other unlawful act against public order or authority or any consequences thereof;

Any fire, flood, explosion, earthquake, volcanic eruption, epidemic, pandemic, quarantine, public health emergency, storm, lightning, hurricane, tornado, tropical storm or any other adverse weather conditions;

Any strike, lockout, labour relations issues or other industrial disturbance, whether involving Wolfpack Weekends employees, employees of its suppliers or others upon whom Wolfpack Weekends relies;

Any decision of any governmental authority or legislative body having jurisdiction and whose action or inaction may affect the conduct of Wolfpack Weekends’ operations, including but not limited to a travel advisory issued by a government;

Any default from a supplier or third party activity organizer upon whom Wolfpack Weekends relies for the performance of the whole or any part of the Services described and provided herein; or

Any other causes beyond the reasonable control of Wolfpack Weekends, whether actual, threatened or reported, which may interfere with Wolfpack Weekends’ operations or that of its suppliers.

Governing Law:

The Parties hereby agree that all actions brought in respect of this Agreement, or any Services delivered pursuant to this Agreement, shall be brought before a Competent Court of Canada, and the parties hereby acknowledge the exclusive jurisdiction of the Competent Courts of British Columbia. Therefore, you agree that: (i) the Service shall be deemed solely based in British Columbia and (ii) the Service shall be deemed a passive one that does not give rise to personal jurisdiction over us, either specific or general, in jurisdictions other than British Columbia. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. You agree to submit to the personal jurisdiction of a competent court located in, British Columbia or the Canada District Court, for any actions for which we retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of a our copyrights, trademarks, trade secrets, patents, or other intellectual property or proprietary rights, as further set forth in the Arbitration provision below.
